虽有前款规定，在海上货物运输合同中明确约定合同所包括的特定的部分运输由承运人以外的指定的实际承运人履行的，合同可以同时约定，货物在指定的实际承运人掌管期间发生的灭失、损坏或者迟延交付，承运人不承担赔偿责任。但是，此种约定应当在提单中载明；未载明的，不得对抗善意第三人。
